Terms of Service

Nudge (“we”, “us”, “our”) is a distribution infrastructure platform that enables software developers (“Customers”) to deliver automatic updates to end-users of their desktop applications.

Nudge is a distribution platform. We do not inspect, compile, verify, warrant, or take editorial responsibility for the content of files uploaded by Customers or distributed to end-users. Our role is analogous to that of a web host or CDN.

By creating an account or using any Nudge service, you agree to these Terms. If you are accepting on behalf of a company, you represent that you have authority to bind that entity.

You are solely responsible for all files, applications, and content you upload and distribute through Nudge. This includes, but is not limited to:

• Ensuring you have the legal right to distribute the software.
• Complying with all applicable laws, including export control laws.
• Not distributing malware, spyware, ransomware, adware, or any malicious code.
• Not distributing unlicensed or infringing software.
• Obtaining appropriate end-user consent before installing software on their devices.

You may not use Nudge to distribute:

• Malware, trojans, rootkits, keyloggers, or any software designed to harm.
• Software that violates third-party intellectual property rights.
• Software that facilitates illegal surveillance or privacy violations.
• Content that violates applicable law in your jurisdiction or the users' jurisdiction.

We comply with the Digital Millennium Copyright Act. If you believe content distributed through Nudge infringes your copyright, send a takedown notice to dmca@unicornfamily.dev with: (a) identification of the copyrighted work; (b) identification of the infringing content; (c) your contact information; (d) a statement of good faith belief; (e) your signature.

We reserve the right to suspend or terminate any account or revoke any build that we reasonably believe violates these Terms, without prior notice. We may also cooperate with law enforcement requests.

Nudge is provided “as is” without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or that any distributed software is safe, functional, or fit for any purpose. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

To the maximum extent permitted by applicable law, Nudge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service, including damages caused by software distributed through our platform. Our aggregate liability is limited to the amount you paid us in the 12 months preceding the claim.

We may update these Terms at any time. Continued use of the service after changes constitutes acceptance. We will make reasonable efforts to notify Customers of material changes.
